1. Introduction & Agreement To Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”, "User") and PRORESUMESIN SERVICES PVT LTD (Corporate Identity Number: U62099KL2024PTC087549), an Indian company ("Company", “Proresumes”, “we”, “us”, or “our”), concerning your access to and use of the proresumes.co.uk, proresumes.us, proresumes.in, proresumes.eu, ae.proresumes.net, sa.proresumes.net, qa.proresumes.net, ca.proresumes.net, au.proresumes.net, af.proresumes.net, and proresumes.net websites, as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Platform” or "Site").

We provide digital Resume writing and related career services globally, operating from our base in India. While these Terms are intended to apply to all users, certain mandatory local laws in your jurisdiction of residence may apply and will be respected by us to the extent legally required.

You agree that by accessing the Platform and/or placing an order for our services, you have read, understood, and agree to be bound by all of these Terms.

IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE PLATFORM AND OUR SERVICES, AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on the Platform from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time and for any reason. We will alert you about any changes by updating the “Last Updated” date of these Terms, and you waive any right to receive specific notice of each such change unless required by applicable law. It is your responsibility to periodically review these Terms to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms by your continued use of the Platform or our services after the date such revised Terms are posted.

The Platform and our services are intended for users who are at least 18 years of age. Persons under the age of 18 are not permitted to use or register for the Platform or our services.

2. Our Services

Proresumes offers a range of professional career services including, but not limited to, Resume writing, cover letter writing, LinkedIn profile optimization, mock interviews, and portfolio development (collectively, "Services"). Detailed descriptions of our service packages and add-ons are available on our Platform.

3. Intellectual Property Rights

Unless otherwise indicated, the Platform is our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Platform (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of India, foreign jurisdictions, and international conventions.

Upon successful completion and full payment for our Resume writing or other document creation services, you, the client, will own the final, delivered document (e.g., your Resume, cover letter) for your personal, non-commercial job-seeking purposes. We retain the right to use a non-identifiable (anonymized) version of the documents for our portfolio, samples, or internal training purposes, ensuring your personal information is protected.

The Content and the Marks are provided on the Platform “AS IS” for your information and personal use only. Except as expressly provided in these Terms, no part of the Platform and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

Provided that you are eligible to use the Platform, you are granted a limited license to access and use the Platform and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use related to our Services. We reserve all rights not expressly granted to you in and to the Platform, the Content, and the Marks.

4. User Representations

By using the Platform and our Services, you represent and warrant that:

(1) all information you submit (including registration information, personal details, education, and employment history) will be true, accurate, current, and complete;

(2) you will maintain the accuracy of such information and promptly update it as necessary;

(3) you have the legal capacity to enter into these Terms and you agree to comply with these Terms;

(4) you are at least 18 years of age;

(5) you will not access the Platform through automated or non-human means (e.g., bots, scripts);

(6) you will not use the Platform or our Services for any illegal or unauthorized purpose; and

(7) your use of the Platform and our Services will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Platform or our Services.

5. Ordering and Payment

To complete your order for our Services, we require certain personal and professional information, such as contact details, education, and employment history. If any necessary details are missing, we will contact you to gather the required information.

Proresumes requires payment in full in advance to begin processing your order. Payments can be made securely via the payment methods indicated on our Platform (e.g., PayPal, credit/debit cards via Razorpay or other gateways).

All prices listed on the Proresumes Platform are subject to change without prior notice. However, if a price changes after you have placed an order, the price at the time of purchase will apply. If our prices for the exact same service are reduced within seven (7) calendar days of your purchase, we will refund the difference upon your written request to our support email.

If an incorrect order is placed (e.g., selecting a service type not appropriate for your career level as determined by us), we will contact you to discuss the discrepancy. You will have the option to pay any difference for the correct service, receive a partial refund if applicable, or receive a full refund if you choose not to proceed with the corrected order before work has commenced.

We reserve the right to refuse or cancel an order at our discretion. If we decline or cancel an order after payment has been made but before work has commenced, we will notify you within a reasonable timeframe (typically 24-48 business hours) and process a full refund.

All payments shall be in the currency indicated on the payment page for your selected region or as determined at checkout. You agree to provide current, complete, and accurate purchase and account information for all purchases. You authorize us (and our third-party payment processors) to charge your chosen payment provider for your purchases.

6. Service Delivery and Turnaround Times

Your completed Resume and other documents will be delivered via email in Microsoft Word and PDF format (where applicable) to the email address you provided at the time of order. If any crucial information required from you is missing, we may be unable to provide a final PDF version until these details are supplied.

Our standard turnaround time for most Resume writing services is 2-3 business days. For services with an "Express Service" option, the turnaround time is typically 24 hours. Turnaround time commences only after we have received all required information from you (e.g., completed questionnaire, existing Resume if applicable).

These turnaround times are based on average completion rates and may vary depending on our current workload, the complexity of your order, and the completeness of the information you provide. If we anticipate any significant delays, we will notify you promptly to discuss an updated timeframe.

While we strive to meet these timelines, Proresumes cannot be held liable for any inconvenience or loss resulting from exceeding estimated turnaround times, provided we have communicated any delays. No refunds will be provided solely due to delays unless agreed upon by us in exceptional circumstances or where we fail to communicate significant delays.

We advise you to check your email inbox, including junk or spam folders, regularly during the order process. We do not accept liability for undelivered emails if they are marked as spam by your email provider or are undeliverable due to incorrect email address provided by you.

7. Cancellation, Amendments, and Refund Policy

Our Services involve the creation of personalized, custom-written content tailored to your individual needs and specifications. Once work has commenced on your order, we generally do not offer refunds because the service is personalized and resources are allocated.

Cancellations:

  • If you wish to cancel your order, you must contact us immediately at support@proresumes.net (or the relevant contact email for your region).
  • If we have not yet commenced any work on your order, we may, at our discretion, issue a full or partial refund. Approved refunds will be processed within 5-7 business days from the confirmation of cancellation.
  • If work has already begun (e.g., a writer has been assigned, initial drafting or research has started), refunds will generally not be possible.

Amendments & Revisions: To ensure your complete satisfaction, we offer 12 months of free unlimited revisions to your Resume (and other documents included in your package, like cover letters or LinkedIn profiles) after the initial drafts are completed and delivered. Revisions must be within the scope of the original order (e.g., for the same career target, not a complete rewrite for a different career path).

Refunds:

  • As stated, due to the personalized nature of our services, refunds are generally not provided once work has commenced.
  • If you believe the service delivered does not meet the agreed-upon requirements or is of unsatisfactory quality, please contact us immediately. We are committed to working with you through our revision process to ensure you are satisfied with the final product.
  • Refunds in exceptional circumstances, including those processed for cancellations made before work commencement, are at the sole discretion of Proresumes and will be processed within 5-7 business days.

This policy does not affect any statutory rights you may have under applicable consumer protection laws in your jurisdiction that cannot be excluded by agreement.

8. User Generated Contributions & Submissions

If you provide us with content, including your existing Resume, career history, comments, suggestions, ideas, or feedback (collectively, "Contributions" or "Submissions"), you represent and warrant that you have the right to do so and that such Contributions do not infringe on any third-party rights.

By providing Contributions, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, adapt, and translate such Contributions solely for the purpose of providing the Services to you and for our internal quality improvement and service development. We will treat your personal information within these Contributions in accordance with our Privacy Policy.

Any unsolicited Submissions (ideas, feedback, etc., not directly related to fulfilling your order) provided by you to us are non-confidential and shall become our sole property to use for any lawful purpose without acknowledgment or compensation to you, unless otherwise agreed in writing.

9. Prohibited Activities

You may not access or use the Platform or our Services for any purpose other than that for which we make them available. Prohibited activities include, but are not limited to:

  • Using the Services for any illegal or fraudulent purpose.
  • Providing false, inaccurate, or misleading information.
  • Attempting to circumvent any security features of the Platform.
  • Interfering with or disrupting the Platform or our services.
  • Using any information obtained from the Platform to harass, abuse, or harm another person.

10. Third-Party Websites and Content

The Platform may contain links to other websites ("Third-Party Websites") or content from third parties. We are not responsible for such Third-Party Websites or Third-Party Content. Your interaction with any Third-Party Website is at your own risk.

11. Platform Management

We reserve the right, but not the obligation, to: (1) monitor the Platform for violations of these Terms; (2) take appropriate legal action against anyone who violates these Terms; (3) refuse, restrict access to, or limit the availability of any Service; (4) manage the Platform in a manner designed to protect our rights and property and to facilitate its proper functioning.

12. Privacy Policy

We care about data privacy and security. Please review our Privacy Policy posted on the Platform. By using the Platform or our Services, you agree to be bound by our Privacy Policy, which is incorporated into these Terms.

13. Term and Termination

These Terms shall remain in full force and effect while you use the Platform or our Services. We may terminate your access or use for any reason, including breach of these Terms, at our sole discretion, without notice or liability. Provisions of these Terms that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Platform or discontinue our Services at any time or for any reason at our sole discretion without notice, except that any orders already paid for and accepted will be fulfilled according to the terms in place at the time of purchase or an appropriate refund will be offered. We are not liable for any modification, price change, suspension, or discontinuance.

We cannot guarantee the Platform will be available at all times. We may experience interruptions, delays, or errors. You agree that we have no liability for any loss, damage, or inconvenience caused by your inability to access or use the Platform during any downtime.

15. Governing Law and Dispute Resolution

These Terms and your use of the Platform and our Services are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in India, before a single arbitrator. The arbitration shall be administered by the appropriate arbitration institution [Consider specifying an Indian arbitration institution or ad-hoc arbitration under the Indian Arbitration and Conciliation Act, 1996]. Judgment on the award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction.

The language of the arbitration shall be English.

16. Disclaimer

THE PLATFORM AND OUR SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE PLATFORM AND OUR SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE PLATFORM AND OUR SERVICES AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE PLATFORM'S CONTENT OR THE CONTENT OF ANY WEBSITES LINKED TO THE PLATFORM.

WHILE WE STRIVE TO CREATE HIGH-QUALITY CAREER DOCUMENTS, WE DO NOT GUARANTEE THAT OUR SERVICES WILL RESULT IN A JOB OFFER OR ANY PARTICULAR CAREER OUTCOME. SUCCESS IN A JOB SEARCH DEPENDS ON MANY FACTORS BEYOND THE SCOPE OF OUR SERVICES.

17. Limitation Of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

CERTAIN JURISDICTIONAL LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.

18. Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, employees, and agents from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of:

(1) your Contributions or information you provide;

(2) your use of the Services;

(3) your breach of these Terms;

(4) any breach of your representations and warranties set forth in these Terms; or

(5) your violation of the rights of a third party.

19. Electronic Communications, Transactions, And Signatures

Visiting the Platform, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on the Platform, satisfy any legal requirement that such communication be in writing. YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS, AND OTHER RECORDS, AND TO ELECTRONIC DELIVERY OF NOTICES, POLICIES, AND RECORDS OF TRANSACTIONS INITIATED OR COMPLETED BY US OR VIA THE PLATFORM.

20. Miscellaneous

These Terms and any policies or operating rules posted by us on the Platform or in respect to the Services constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision. These Terms operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. If any provision or part of a provision of these Terms is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these Terms or use of the Platform or Services.
